Meeting Minutes of June 23, 2005

 

In attendance: Paul de Ruyter, chair, George Hitchcock, Lee Ash and Chip Bradish

 

Excused absence: John Baldwin- arrived from aquaculture at 4:50 PM.

 

Recording secretary: Rex McKinsey filling in for Joel Glasser.

 

Chair opens meeting at 4 PM.

 

Public Statements

 

8W sub-tenants Roxanne Pratten and Jim Shannon in at the request of board to discuss Pier Corp expectations for businesses in the excursion vessel area. Shannon runs a charter fishing boat and Pratten runs sailboat Kittiwake. Board and sub-tenants discuss special conditions associated with those berths and Pier Corp mandate for economic development.

 

Continue hearing on Float space 10W from last meeting

 

Attending were Joy and John Ries and their counsel Mr. Jamie Veara. Chair asks board if they would like to deal with renewal first then hear from Veara or vice versa. Hitchcock wanted to hear from those present.

 

Discussion with attendees regarded the problems with the space; shortened Watersheet, lack of grandfather due to RFP in 1998, condition of Hindu and not having a renewal contract and required deposit to work from. Questions arise as to why the estate did not protect the corp. assets.

 

Motion by Lee Ash that we inform the estate and their counsel that by our next meeting unless they make a formal application and pay their fee, we have no choice but to move on. GH seconds.

 

Discussion: CB- don’t need yet another chance, PDR- amply clear record that license has defaulted, GH- in favor of another chance. Vote 2-2-1 (JB abstains)

 

De Ruyter makes a motion to continue hearing for 14 days during which period licensee has an opportunity for the formal licensee holder to submit application and pay fee. LA second. Additional discussion ensued. Vote 2-2-1 (JB abstains)

 

De Ruyter motion to continue hearing for float space 10W until next meeting. LA second.

Discussion: GH can we hear from our attorney on our rights and obligations? Pier Manager reviews existing public process town would follow. CB- we would be in a worse mess in two weeks on this. Chair calls for a vote. 2-2-1 (JB abstains)

 

Additional discussion: CB- if Hindu were coming back, fine, but we are losing control. LA- Might be better with an RFP. J Veara- you could get someone else in there that would also sub-let. Not a whole lot of people beating down the  door for the space.
