William N. Rogers II,
PE, PLS and Lester Jay Murphy, attorney, on behalf of The Three Telegraph Hill
Realty Trust and The Five Telegraph Hill Realty Trust to convey Parcel 1 to the
Five Telegraph Hill Realty Trust to form Lot 11 and, Parcels 2 & 3 to be
conveyed to the Three Telegraph Hill Realty Trust to form Lot 12 at the
property located at 3 Telegraph Hill and 5 Telegraph Hill, Provincetown, MA.
Plans were submitted. Lot 11 would be 19,755
square feet and lot 12 would 9,815 square feet both conform to area and
frontage.
Planning Board recommended returning with formal
application.

PE, PLS on behalf of Gunther Realty, LLC to combine lots 1, 2 & 3 to form
Lot 1 for a total area of 15, 565+/- sq. ft. at the property located at 27-31
Bang’s Street, Provincetown, MA.

Case #2007-28 Site Plan Review (Continued to February 20, 2008)
Application by Edward Malone under Article
2, Section 2320 of the Zoning Bylaws for High Elevation Protection District A
and, under Article 4, Section 4100, Dwelling Units and Commercial
Accommodations. The applicant seeks approval for the proposed construction of
20 residential units in 7 buildings and associated site construction and demo
the garage workspaces at the property located at 19 Race Point Road (Res3
Zone).
Case #2007-29 Site Plan Review (Continued to February 20, 2008)
Application by Edward Malone under Article
2, Section 2320 of the Zoning Bylaws for High Elevation Protection District A
and, under Article 4, Section 4100, Dwelling Units and Commercial
Accommodations. The applicant seeks
approval for the proposed construction of 15 residential units in 6 structures
and associated site work at the property located at 35 Race Point Road (Res3
Zone).
Case #2008-01 Site Plan Review (Continued from January 16, 2008)
Application by Miriam L. Gross under
Article 2, Section 2320 of the Zoning Bylaws for High Elevation Protection
District A. The applicant seeks approval for the construction of a 16’ x 20’
shed (proposed garage) on sono tubes at the property located at 60 West
Franklin Street, Provincetown, MA (Res1 Zone).
Chet Lay, Slade Associate and Gary Joseph, builder
representing applicant. Site visit was conducted and all Planning Board members
attended.
Kevin Rich notified applicants that application
should be changed from shed to garage and reminded applicants that building
codes for garage must be met.
Howard Burchman questioned whether the proposed
garage would detract from scenic qualities or blend in with the natural
landscape as required in regulations given the fact that it is a prefabricated
structure, etc. Chet Lay responded that applicant would be willing to have the
structure shingled.
Motion: to approve Plan 2007-110 revised as of
February 6, 2008contingent on the following:
-garage is to be shingled and have exterior
treatment to make it contextual to primary residence.
-add downspouts into drywell to prevent
erosion
-erosion control during and after
construction
-meet building requirements to garage construction

Lester Jay Murphy,
attorney representing Clancy Realty Trust requested the release of $35,000
being held in escrow account. All work has been completed except for road
markings that will be completed after the winter and are estimated to cost
$1200.

Case # 2007-14
Definitive Subdivision Plan (Continued from previous meetings)
Application by William N. Rogers II, P.E.,
P.L.S. and Lester Jay Murphy, attorney on behalf of Gordon Realty Trust under Chapter 41, Section 81-L
for approval of a proposed subdivision shown on a plan entitled subdivision
plan in accordance with the Rules and Regulations of the Provincetown Planning
Board and as shown on a plan entitled Plan of Land in Provincetown by William
N. Rogers II, P.E., P.L.S., dated June 25, 2007 located at 105 & 109R Bradford Street Extension and 7A & 7B
Point Street, Provincetown, (Res1 Zone), Provincetown, MA.
Mr. Murphy offered a proposal to withdraw the
Definitive Subdivision Plan and keep the existing motel in operation if the
Planning Board endorses an ANR which would allow Mr. Gordon to sell off the
house on the property by making it a legal lot.
