meeting was called to order at 10:00 a.m.

New
Construction Amnesty
David Nicolau had a question regarding an existing 6 unit building and making the units affordable. He wondered about a tax exemption.
Tim Hazel said he would need clarification on affordable and how they are recognized? Doug Taylor reminded everyone that we do have a local preference requirement. The decision is based on the letter of the law and the intent of the law.
Tim said a lottery may not have to occur if it’s not coming through a group. Further Tim said that the tax exemption would be obtained through the Assessor’s office for the landlord.
Under the amnesty rule a building permit needs to be issued to make an illegal unit legal. – Now, as for the lottery, this could be called displacement. The amnesty would be in perpetuity.
Tim Hazel reminded everyone that 40B supercedes the lottery and for the illegal unit to become a legal apartment it must be kept affordable for the person who qualifies.
Doug asked, “How and who determines affordability?”
Tim said the building must be appropriate and habitable then the tax office would provide the income eligibility. Question: “How do we count these as the 10%?”
David Nicolau said that the amnesty issue needs to go to Zoning. Doug countered by saying, “If we know the tenants are eligible then it’s a no-brainer. I’d like to see the community level for a sliding scale.”
David said that we have low, moderate, median levels. The first step for an illegal unit to become a legal unit would be for the matter to go before a building department review.

The lottery hopefully will be completed by April 8th, 2005.

4. completion of common stairwell (did not pass code as drawn & constructed – remake of stair system)
5. Unit 2 – beginning of April 2005

Meadows Motel project: Back portion will be completed by fall.
Tim Hazel then did an update on the CPA. 19 units at the Cape End Manor have been approved.
