Planning Board and
Local Comprehensive Plan (LCP) Implementation Committee Meeting

December 4, 2002, 5:30 PM

 

 

Planning Board Members Present: Anne Howard, Ellen Battaglini, Howard Burchman, Barnett Adler, and Len Bowen

 

LCP Implementation Committee Members Present: Ted Malone

 

LCP Implementation Committee Members Excused Absence: Ginny Binder

 

Also Attending: Martha Hevenor, Cape Cod Commission, and Mark LaTour, Assistant Town Manager

 

Meeting

 

Anne Howard called the meeting to order at 5:30 PM and introduced the Planning Board and LCPIC members present.

 

Anne Howard talked about moving the sign and illumination by-laws from Zoning to the General by-laws. She also stated that the suggestions for by-law changes have to be completed for a Public Hearing that will be at the end of January or the first part of February. It is necessary to bring the items to the Town Meeting without causing problems.

 

Martha Hevenor stated that this year should not be as bad as last year as there are not as many voluminous changes.

 

Some of the items discussed were:

 

  1. Section 2400 – Use Regulations. This section has to be submitted to Town Counsel prior to the Public Hearing and then to the Board of Selectmen.
  2. Section 3213 – Non-Conforming Signs – Length of Time Given for Compliance. Warren Alexander suggests that the DATE should be 5 years. There should be a provision for special cases, e.g., Lobster Pot.
  3. Section 3430 – Illumination. There was a general discussion regarding illumination and illuminated signs.
  4. Section 4162 – There was a discussion as to the possibility of moving Section 5331 from Section 5300 to this location for clarification. It also was suggested to change the working to Special Permit Planning Authority instead of the specifics like Zoning Board of Appeals or Planning Board.
  5. A discussion ensued regarding that anything requiring a Special Permit get a Site Plan Review by the Planning Board.

 

The next joint meeting of the Planning Board and LCPIC will be Tuesday, December 10th at 5:30 PM.

 

Ted Malone moved to adjourn the Joint Meeting at 7:05 PM. The vote was unanimous.
