The meeting was called to order at 4:33 p.m.

Review/amend/approve minutes of 2/8/06

Motion:  Accept the minutes of February 8, 2006 as amended.

Motion by Adams; Seconded by Scholl    Voted 4-0-0.

Old Business:

Review status of 2005 Harbor Plan Amendments: Chairman and Town Manager trying to set up meeting with Truman Henson.

 

Washington Ave. Town Landing: After review of town counsel’s opinion of 1-27-06 it appears that the process will have to be started from the beginning. The Chair met with Paul Gavin, Assessor and received copies of deeds on properties abutting the Town Landing which were copied and distributed to Committee members. K. Adams motioned that the Chairman submit a Request for Legal Services to find out what has to be done (ex. Title search, survey, etc.) and estimated cost of recording the Washington Ave. Town Landing. Funding for this to be decided later.

Seconded by P. Scholl.

The Assessor stated that when approved at town meeting the town has 120 days to purchase easements and record documents.

R. McKinsey suggested that the Chairman send a letter to the Selectmen that if an abutter’s building is in fact encroaching on the Washington Ave. Town Landing then an encroachment fee be paid.

Motion voted:  4-0-0

 

D. Taylor commented on conversion of waterfront property from commercial to residential use. He talked with Gitto, DEP, and Lou stated that 310 CMR 9.51-9.53 applies and owner must file for Chapt. 91 license. It also must comply with the Harbor Plan.

According to reading of CMR’s none of the first floor of the building can be for residential use.

 

Waterways Applications W96-5487-N, 161 Commercial St., Boatslip. Chairman to write letter to Lou Gitto, DEP to request applicant survey property line with Atlantic Ave. Town Landing and install signs that rest rooms are open to public.

Waterways Applications W96-8204-N, 47 Commercial St. and W96-9001-N, 437-439 Commercial St. Chairman to notify Lou Gitto, DEP, to supply copies of original applications for committee review.

 

A. Brock requested Chair to write to Gitto requesting that WA W96-6045-N, Hall, that since there are separate deeds included in the application that in future if parcels are sold separately then new owners must file for Chapter 91 licenses.

 

Beach Cleanup status: Chairman sent email to Chief Meyer asking for schedule and help from Barnstable County Sheriff Dept. to clean waterfront beach as soon as possible then regular scheduled cleaning. Meyer out of office on Tues. and Wed. this week.

 

New Business: none

 

Chair handed out copies of P’Town Ch. 91 License Review Process issued in Sept. 2000 for review to see if updating is necessary.

 

K. Adams made motion to adjourn at 5:52pm. Seconded by A. Brock.
