AGENDA

Public Comments

Barbara Rushmore thought  the BoH should be interested in anything that might be life threatening such as having an evacuation route in case of an incident from the Pilgrim nuclear plant.

Old Business

415-417 Commercial Street

Appeal Health Agents Decision (number of bedrooms)

J. Lester Murphy, attorney, spoke on behalf of his client, Harriet J. Hobbs, Trustee of Fine Arts Realty Trust of the above address.  He requested an additional amount of time to research the issue.

Motion:  Move to postpone the above case until the next BoH meeting on January 22, 2009.

Motion:  John Livingstone     Seconded:  Jerry Anathan      Vote:  3-0-0.

New Business

698 Commercial Street (Cape Inn)

ACO Request

J. Lester Murphy represented the owner Fred Sateriale.  Jane Evans, the Health Agent, did an inspection of the Cape Inn’s septic system and found that they are failed since not enough separation to groundwater.  Since Phase III of the sewer system could extend into the area within 1 year or so– allowing the Cape Inn to hook up to the sewer – the owner would prefer an ACO.

Motion:  Move to approve an ACO for 698 Commercial Street. No “quick fix” is required at this time since the septic system inspection report provided by Jason Ellis, R.S. state that the systems are in good working order.  Also 30 days was allowed to record the ACO.

Motion:  John Livingstone     Seconded:  Jerry Anathan      Vote:  3-0-0.

716 Commercial Street (Breakwater Motel)

ACO Request

The situation and owner are the same as the above case.

Motion:  Move to approve an ACO for 716 Commercial Street.

Motion:  Jerry Anathan                   Seconded:  John Livingstone     Vote:  3-0-0.

A-Pro-Rooter

New Septage Hauler

Mr. Keohane spoke on behalf of the owner, James McGrath.  The company, A Pro Rooter, does all the pumping for Stop and Shop supermarkets. The Health Agent recommends approval.

Motion:  Move to recommend approval of A Pro Rooter as a new septage hauler with the provision that they must provide the health agent with copies of all the pumping records for both Provincetown Stop and Shop as well as any other system locations in town that they service within a week of pumping if the septage is not being transported to the Tri-Town Treatment Facility.

Motion:  John Livingstone     Seconded:  Duane Gregory    Vote:  3-0-0.

5 Browne Street

Appeal Health Agents Decision; Bedroom Count

Jane conducted a bedroom count for unit #3.  It has been historically listed as a two bedroom cottage by the Assessor’s Office but it doesn’t quite meet the dimensions of 70 s.f. per bedroom (8s.f. short). The other bedroom criteria are met. The septic was also designed with the two bedroom count for this cottage.

Health agent doesn’t feel there is any public heath issue, since the septic design incorporates 2 bedrooms

Motion:  Move to allow the Cottage #3 at 5 Browne to be considered two bedrooms.

Motion:  Duane Gregory        Seconded:  Jerry Anathan      Vote:  3-0-0.

6 Winslow Street

Request to Maintain Operation of Septic System

Chris Sales, the owner, and Dennis Sullivan were present. 6 Winslow Street has Title 5 is on the property of 7 Webster Place and presently shared by both properties.   7 Webster Place has intentions to hook into the sewer. 6 Winslow  prefers maintaining their usage of the title 5 on the Webster Place property.  They were told that the easement regarding the issue would have to be rewritten.

Motion:  Move that in the event that 7 Webster Place should connect to the sewer, the septic system serving both 6  Winslow Street and 7 Webster be allowed to remain for the use of 6 Winslow.

Motion:  Jerry Anathan                   Seconded:  Duane Gregory    Vote:  3-0-0.

Discussion

Smoking Cessation Class

Barbara Rushmore requests the BoH  put an article in the Annual Town Meeting warrant asking for $1,400 for the Town to sponsor a class on smoking cessation.

She was asked by the Board if she had any brochures about the group that would give the class.  There was no information available and Dr. Livingstone suggested that some classes are valid and some have no real value.  He would like some literature on this.  She was thanked for her input and asked to research the different classes available, their cost, etc. and then the BoH would consider the matter.

V.      Approval of Minutes for October 16, 2008

Appropriate members not present to approve.

Any other business that shall properly come before the Board

Duane distributed  a draft of a BoH regulation regarding rental inpections.  She had an informal meeting with Michele Couture and was assured that inspecting rental properties was not a move to raise money but only to safeguard the public health.

Agenda item at the next BoH meeting on January 22nd for discussion

Health Agent’s Report

Jane said that she has been very active with the sewer team and a lot of it had to do with Fred Sateriale’s properties.

Brian had three things to report:

1.  A dead coyote had been found and tested negative for rabies.

2.  The rabies baiting program will not be funded by the State next year so will not

      resume in the spring.

3.  He is dealing with a tenant problem which is connected to a fire safety issue.
