Variance Request

Jerry Anathan stepped down from this case.  Attorney Jay Murphy and Gary Locke presented the case.  The town counsel’s advice was finally received and the following motion was made:

Motion:  Move to deny the variance request.

Motion:  Duane Gregory     Seconded:  Ken Janson     Vote:  3-0-0.

Variance Request

Emily Beebe, R.S. presented the case.  Both Jane Evans and Emily Beebe as well as the BoH discussed the variances at length culminating in the following motion:

Motion:  Move to approve the plan with the revision date of April 24, 2008 with the following conditions:

1.     Redesign the leach area so as to eliminate the variance requesting a 5.5% reduction in the leaching capacity.

2.     A deed restriction limiting the property to the existing 2 bedrooms must be recorded at the Barnstable Registry of Deeds with proof of this recording presented to the Health Agent prior to the issuance of a Septic System Installation Permit.

 

Discussion

Recycling Committee Chair Michael Leger

Michael Leger said that he has had many meetings with his committee and their DPW liaison, Jim Denietolis, who was present, to encourage their mission of  recycling as much as possible.  Michael brought in copies of a few BoH regulations that he felt supported his plea for help.  He felt that every shop that sells things that could be eaten on the premises should provide a recycle bin.  He wanted help from the BoH to enforce this.  He said that he has gone through rubbish barrels outside of several stores, such as Grand Union and Cumberland Farms and found the rubbish full of recyclable items such as water bottles, etc. 

 

Also, he would like the BoH to inform the licensed trash haulers who do not dispose of their trash at the Provincetown transfer station of our request. 

 

Brian Carlson said that all the food service permit holders were sent recycling literature on April 1.  Jane Evans stated that she will be sending out further information to the appropriate food service permit holders stating the existing Board of Health recycling regulations and with information as to where recycling bins may be purchased.

 

Michael Ledger was thanked for his presentation.

         

Emergency Preparedness Plan

Brian Carlson did a power point presentation along with Sean O’Brien, Emergency Manager from Barnstable County and Tina Holloway a registered nurse with Barnstable County.  The presentation was very informative and represented a dress rehearsal for a Monday night presentation to the BoS.

Health Agent’s Report

Jane Evans said that she is conducting the mandatory Grease Education Class on May 28th  for those new food service permit holders for 2008.    

She’s also sending the mailing out for the recycling and feels that Mo-Jo’s and the hot dog stands would be people who could benefit the most from this notification.  

 

This is a 1st for the board – the Wired Puppy was given seating capacity which requires a handicapped accessible bathroom and they just don’t have the space to do it.  They will be requesting a variance from the state Board of Plumbing and Gas Fitter regulations giving them permission to operate without a handicap accessible bathroom.  They will be asking for a letter of support from the BoH which is required as part of the variance request application by the Board of Plumbing and Gas Fitters.  

 

Health Inspector’s Report

Brian Carlson said he is doing the rabies baiting and he sent out the fact sheet and the notice to Dr. O’Malley’s and Dr. Lacy’s (OCHS) office directing people where to get information if they are exposed to the vaccine pellet.  He has no data back from the Center for Disease Control (CDC) regarding the wild rabies surveillance program.  Eventually the figures will come through.
