Title 5 Variance

William Rogers, II was in attendance and dropped by to see if the Board had received any decision from the Town’s legal counsel.  The BoH hadn’t.  Marie Moreau, an abutter from 25R Bangs Street, had sent in a letter and was also waiting to hear the disposition of the case.    

Motion:  Continue the case until the May 1st meeting.

Title 5 Variance

 

Jason Ellis presented the case.  Jerry Anathan who is an abutter - stepped down.  The house has three cesspools, one of which is collapsed.

 

Jane Evans brought to the Boards attention that due to the type of variances being requested (i.e. reduction in size of leaching area) that the new Board of Health regulation that allows the Board to require an Administrative Consent Order rather than approve heavily varianced septic systems might be the way to go.  Jason said that the county will loan money (if you’re over 60) for a Title 5 septic system, which would then become a lien on the property until it changes hands.  Jane said she believed that the loan program also includes sewer betterments.

 

Motion:  Move to require the property owner to enter into an Administrative Consent Order.  The two existing cesspools must be inspected and the Health Agent may require a quick fix.   The Health Agent must conduct a walk-thru of the building to verify the six bedrooms.

Discussion

Proposed Hearing Loss Prevention Regulation

Tom Gaudreau recused himself from the discussion and left the meeting at 5:30 p.m.  Sharon Lynn (Town Manager) and David Gardner (Asst. Town Manager) took part in the discussion with the BoH. 

 

Dr. John Livingston led the discussion by stating that he feels it’s a very important issue and he would like some clarity regarding Sharon’s concerns about a BoH regulation; what is the disadvantage of going ahead with it?

 

Sharon said that she was looking at a timing issue and what the BoS will decide – she needs something that’s enforceable. 

 

Duane asked if the noise is particularly related to motorcycles?  John said, “No, any place where there is a risk of potential hearing loss.”  John’s research cites that anything registering 82 decibels and above is damaging from 20” away. 

 

The discussion was quite lengthy and fully explored the pros and cons with the final conclusion being: 

John said that he and Jane have been working on this and let’s continue working on this.  The next step will be to include the new police chief in discussion some time in August.      

 

Health Inspector’s Report

Brian Carlson will give a presentation on the Town’s Emergency Plan at the next BoH meeting that he will also be presenting to the BoS.

He was asked about the presentation that he made at Napi’s last week.  He said that only a handful of people attended – all those who would be involved in an emer­gency happening.

 

Health Agent’s Report

Jane Evans spoke about a condo issue she was having.  Four of the five units want to connect to the sewer.  She explained that – in this particular case – it was not optional.  They are not being invited but MUST hook up to the sewer.

She also said that she will be attending a seminar on Lyme disease on Friday.  Jane also mentioned that there are several new food service permit holders and establishments so she will be holding a Grease Education class in the near future. 

 

There will be a large agenda for the next BoH meeting.
