Old Business

15 Hobson Avenue

Variance Request for revised plan

Emily Beebe presented a new plan for 15 Hobson Avenue.  The BoH informed the applicants that they are waiting for an opinion from town counsel. 

 

Motion:  Approve the revised plan dated September 5, 2007 for 15 Hobson Avenue with a deed restric­tion limiting the number of bedrooms to the existing 2 to be recorded at the Barnstable County Registry of Deeds.  Proof of recording must be provided to the Health Agent prior to issuance of the Septic System Installation Permit.  The Septic Installation Permit will not be issued until such time as the Board of Health (BoH) can determine through legal counsel the status of requiring an upgrade to the system at 13 Hobson Avenue.  The BoH reserves the right to order the septic system serving 15 Hobson Avenue be redesigned if the owner of 13 Hobson Avenue is ordered to install a Title V system.

New Business

75 Provincelands RoadHatches Harbor Condominium

ACO Request

Health agent recommends approval.

Motion:  Approve an ACO for 75 Provincelands Road.

Discussion

There was a discussion of the joint Board of Selectmen’s meeting with the Board of Health.  It was thought that a starting place might be to schedule a joint meeting between the BoH and the Licensing Board.  All of the properties involved in trash pick-up regulations and rental inspections should be educated to know the Board of Health concerns are health and safety.

 

John Livingstone said it would be incumbent on the BoH to create language that identifies bona fide health issues.  Jane Evans said she will look up the regulations for the minimum requirements for human habitation to assist in future inspections.

 

Health Agent’s Reports

Jane Evans attended an Advanced Soil Evaluator workshop in Brewster.  She now has an advanced certification.  The grease trap class was successful and only 4 food service places out of 89 did not attend.  These four, at present time, are not eligible to renew their licenses for next year.  Jane also pointed out a regulation within Title 5 stating that variances for a septic system will not be granted if connection to a sewer system is available.

 

 

Board Members’ Statements

John Livingstone said that at the upcoming BoS’ Monday meeting there will be a discussion on noise; Sharon Lynn has invited John to attend and to discuss motorcycle noise and its impacts on health.  It’s not a formal presentation of the BoH but just an informative one.
