6 Sandy Hill Lane - ACO Request
Jerry
Anathan stepped down. Jerry Anathan and
Cassandra Benson gave a brief overview of their proposed project. The Health Agent, after review, recommends
approval with conditions.
Duane
Gregory asked quite a few questions about the project and suggested a few minor
adjustments of the conditions. Jane explained that the ground water level
regulations have changed since this septic was installed. You now need 5 ft of
separation instead of 4 ft, which would mean a failure of the existing system.
Duane
wondered what would happen if the sewer doesn’t come in. Jerry and Cassandra explained that they have
put money into an escrow account for the connection to the sewer or Title V.
Motion: Approval of an ACO with the following
conditions:
1. A septic system inspection report must be submitted to the Health Agent
for review by the Board of Health as soon as weather conditions allow and any
"quick fix" as determined necessary by the BoH must be completed
within 30 days of ownership of the property.
2. The Administrative Consent Order must be recorded at the Barnstable
County Registry of Deeds within five days of the closing and proof of recording
and first payment provided to the Finance Department, with a copy of the proof
of recording and proof of payment provided to the Health Agent, within five
days after the recording takes place.

Jane
Evans asked the members of the BoH to please notify her in advance if they
cannot attend a meeting. She could then see to it that people are
notified. She would post a notice saying
postponed if a quorum was not available.
Jane
also felt that the board should look for some kind of resolution on the
previously discussed rabies issue. John
Livingstone felt the police department should have a protocol for any occasion
that Ruth Ann Cowing is unavailable. The
refrigerator for the purpose of placing dead animals who died from a suspicion
of rabies is now in the cemetery shed. Tom G. said that all we’re looking for
is what is done when Ruth Ann isn’t here.
The Health Agent thinks we should send a letter from the BoH to the
Acting Police Chief, Warren Tobias.
Jerry Anathan will draft one for review. Also we should ask about
procedure for responding to a call for a strange acting animal. We should also give them a copy of our
January 18th minutes.
Jane
Evans reported that she had attended a meeting last week of the DEP and MA
health officers and some of the issues dealt with Title 5s and sewerage. She
also found that a terrific sewer system can be closed down by non-functioning
grease traps.
Brian
Carlson reports he had requested the by-laws of the Eastern Nazarene Church and
they haven’t been sent as yet.
