New Business

283 Bradford Street

Administrative Consent Order

Jim Turner presented the case to the Board of Health.  At the present time, there is no quick fix required.  (Across the street from the DNA gallery.)  Dana Faris approved the request.  The term, "future fill" was explained to the new member of the Board.  After a couple of years there will be some freeing up of future gallons as the switch to gravity versus vacuum pump happens.  The money that people are putting in escrow has to be used before 2010 or refunded.

Motion:  Approve the request for the ACO for 283 Bradford Street that will be submitted to the Board of Selectmen (BoS) for their consideration.

8 Conwell Street

Administrative Consent Order

This property is being sold and the new owner, James Carroll, was in attendance.  No quick fix is required.

Motion:  Approve the request for the ACO for 8 Conwell Street that will be submitted to the Board of Selectmen (BoS) for their consideration.

3 Holway Avenue

Administrative Consent Order

No one was there to represent the owner.  The owner has not yet had the cesspool inspected so the Health Agent (HA) doesn't know if a quick fix might be required. 

Motion: Approve the request for the ACO for 3 Holway Avenue that will be submitted to the Board of Selectmen (BoS) for their consid-eration with one condition that the existing cesspools be inspected and any "quick fix" deemed necessary by the Health Agent be performed.

20 Shank Painter Road

Administrative Consent Order

Reverend James W. Cox of the Provincetown United Methodist Church was in attendance. Currently he has cesspools which are being pumped frequently.  The HA said that the church is in an area that is going to be highly served by future sewer expansions.

Motion: Approve the request for the ACO for 20 Shank Painter Road that will be submitted to the Board of Selectmen (BoS) for their consid-eration with the condition that the existing cesspools be pumped as needed so as to prevent a back-up of septage into the facility or discharge to the ground.

39 Bradford Street

Administrative Consent Order

Hugh Gallagher, one of the condo owners, represented the condo group and had all their approval signatures. 

Motion:  Approve the request for the ACO for 39 Bradford Street that will be submitted to the Board of Selectmen (BoS) for their consider-ation.

6 Dyer Street

Administrative Consent Order

Ken Janson disclosed that he is a guesthouse owner but since there was no objection, he sat on the case.  The property at 6 Dyer Street has a relatively new septic system but the pump was improperly installed and a whole lot of money that has been invested in this problem. 

Motion:  Approve the request for the ACO for 6 Dyer Street that will be submitted to the Board of Selectmen (BoS) for their consideration.

Health Agent’s Report (Jane Evans)

President's mandated rules:

In the July 9th edition of the Cape Cod Times the mandates from the President were discussed.  There are many requirements BUT none of them have been funded.  Provincetown has 1.5 agents, a myriad of restaurants and a greatly inflated seasonal population.  Truro, our next door neighbor has a much smaller population and has two full time health agents and a conservation agent.  Go figure!

 

David Nicolau, one of the newly elected members of the BoS, read the article and commented on it.  The BoH said that our staffing doesn’t hurt the HA, it hurts the Town.   According to the article, there’s no department with only one person; most have at least two.  Lobbying for fuller coverage has to be done.

 

Beaches:

Most beaches were opened today.  Ken Janson wondered if we are going to have more testing done?  Reply:  DNA testing is out since it costs $1K each. Kendall & Atkins Lane have always been problems   -   we just had 10 closures.  West side of Coast Guard station is also a recurring problem.  Duane says the areas of where the seaweed accumulates are problem areas.  Once again the pollution could be from any number of problems. 


Health Inspector’s Report (Brian Carlson)

Massage Therapist Complaint:

Brian received a complaint from a licensed massage therapist stating that on the gay.com web-site there was an advertisement regarding erotic massages and even stating the size of the masseur's penis.  This borders - or is - pornography and/or prostitution.  The answer from the BoH was that it's

basically prostitution and should be worked on by the police. 

 

The Health Agent suggested that Brian notify each and every person who is advertising on the website that this is happening and what is approved and acceptable advertising.  Ken advertises his guesthouse on a large website.  So if someone is advertising on a large site, they don’t have to say where their address is and where their practicing.  Jane further advised talking to Ted Meyer, the police chief, and asking for a game plan.  Talk to him about a sting operation. 

 

Final opinion – bring this to the attention of the police.  Tell them we’re responsible for issuing licenses and we would revoke any license if it borders on prostitution.

 

Duane – has seen a person handing out flyers and hawking his massage expertise on the street.  Next time she sees him she’ll get his name.  He hangs out around the Boatslip.  Duane advised Brian to put in a little effort and see what the police can do.

 

Cost of Massage Therapist and Tattoo Licenses:

Brian said a few of the people who have had to get licenses want to know if they can get a reduced rate since they are here for a limited time.  They thought that perhaps a “visiting tattoo artist and visiting massage therapist”  license might be less expensive.  Ken opined keeping the same fee.  The year-round people would be upset by any proposed reductions. 

 

Duane suggested telling them that they should come before us.  Get them on the agenda and inform them that nothing will happen this year.  Fees are set for the following year. 

 

Complaints:

358 Commercial Street

Very simple complaint….. no soap dispensers in the bathroom which was readily rectified. 

 

Standing water on Masonic Place.  The HA said that no sump pumps have been allowed to drain onto Town facilities.  They must be into a dry well.  The issue is public health.  Jane cited some people on Brown Street who experienced so much rain that it blew out their dry wells. 

 

Temporary tattooing in henna.  There is one person in Lopes Square and she does air brushed alcohol tattoo.  A mother complained when her child got a rash.  A sting operation was tried and the tattoo artist said she didn't do henna tattoos and referred the person to West End Salon.  Brian sent the mother a product list of what had been used.

 

Botox Injections:

Word has filtered down that there is a salon planned for a boat dock that will be giving botox injections.  The BoH thought that there should be regulations regarding this.

 

Rabies Brochures:

Brian showed a proposed rabies informational hand-out for people.  It was suggested that a blurb in the paper might also be valuable.  He has talked to Sally Rose and she agreed to put it in the paper.  Another thought for regular BoH coverage might be a small section entitled "Public Health Issue of the Month."

 

Proposed agenda items for BoS/BoH meeting:

1.     Emergency Preparedness

2.     Public Restrooms 

Duane wants to have the first slot in their regular meeting or be heard at a special meeting with the BoS -  maybe at 5:00 p.m.
