Title 5 variance
Emily Beebe on behalf of
Thomas Myers, Trustee. Abutter notification cards submitted. This is a 3 unit
condo with a total of 5 bedrooms. One of the units is for sale and Duane
Gregory, Jerry Anathan and Matt Damon disclosed that they are in the real
estate business but have no active interest in this property at this time.
Variance requested is for setbacks. Jane suggested that applicant be required
to have an alarm on the filters to indicate when they need to be cleaned so as
to prevent backup and overflow.
Motion: Approve variance request provided that a deed
restriction is recorded at the Barnstable County Registry of Deeds limiting the
number of bedrooms on the property to the existing five and proof of recording
be provided to the health agent prior to issuance of the septic system
installation permit. System is required to have an alarm on the septic tank
outlet filter and that that be noted on plan. (120503)

Show/Cause Hearing
Rachel White on behalf of
Rachel and Robert White, owners of property.
Duane Gregory and Ken Janson
recused themselves as they are both abutters to property in question. This
hearing was called by Health Agent because required actions were not completed
by December 2005 deadline. Rachel White asked for an extension of 6 months for
the completion of clean-up due to unforeseen circumstances. Health Agent is
willing to agree to extension with the provision that owners sign an agreement
and adhere to clean-up schedule. Doug Taylor, Building Commissioner supports
granting extension. Rachel White expressed concern that events may occur that
will make schedule impossible to adhere to. BOH members all felt that proposed
schedule was reasonable and that if problems arose that impeded progress
another show cause hearing would be triggered and they would have a chance to
explain and discuss circumstances at that time.
Motion: Grant extension until June 15, 2006 with the
provision that the owner(s) sign an agreement to adhere to the schedule of
clean-up for their property.

Health
Agent’s Report
Jane Evans reported that she
attended a seminar on changes to Title 5 regulations.
She expressed concern about
the coming summer due to her part-time work schedule. She is worried about that
the town may be in jeopardy in terms of Public Health and environmental issues.

Brian
Carlson reported that Serve Safe class is almost full.
He
will be attending a Rabies Task Force meeting next week-there is 1 confirmed
case in Wellfleet.
He is
scheduled to attend a Disease Surveillance Training.
There
is an increase of Hepatitis B in town.
He
presented an Agenda Action Request from Barbara Rushmore requesting that the
BOH support a Warrant Article to supply $3,000 to hold 12 classes, through
Barnstable County, which will aid citizens of Provincetown to quit smoking.
While
all members agree in principal with the intention of proposed warrant, all felt
that this was not the time to ask for the funding of this program given the
current financial constraints of the town.
Matt Damon asked
the board what, if anything, they should do in response to Health Agents
previously stated concerns.
All members felt that they
have done all they could in terms of her part-time employment status.
