SPECIAL MEETING – MONDAY, SEPTEMBER 7, 2005

Chairman Cheryl Andrews opened the meeting at 6:00 PM noting the following attendees:

Board of Selectmen members: Cheryl Andrews, Sarah Peake, Michele Couture, Richard Olson, David Nicolau

Other attendees: Town Manager Keith Bergman, Town Counsel Jonathan Silverstein, Building Commissioner Doug Taylor, Permit Coordinator Maxine Notaro

Planning Board Members Present: Howard Burchman, Winthrop Smith, David  Martin, Ellen Battaglini, Annie Howard, Kevin Rich

The following are meeting minutes, in brief. 

1.         JOINT MEETING WITH PLANNING BOARD

Reallocating Gallons – Growth Management Category 5 – Economic Development

 

            Chairman Cheryl Andrews opened the discussion.

 

1.      How will gallons be measured that we’re using?  How many in a given year will we be using? Discontinuing uses?

2.      Creating new categories.

3.      Procedures

4.      Impediments (maybe not tonight)

5.      Sewer Bank

 

Category 5 – Call it Economic Development.

 

Howard Burchman commented that the new draft revision to the By-Law is virtually unintelligible.  One sentence runs the entire paragraph.

Policy – David Martin – preference for existing business.

Howard Burchman – Do we want to keep gallons in category?

David Nicolau – original idea was to replace what we lost.  Now it has evolved.  My preference to reallocate to original categories at discretion of Board of Selectmen.

Sarah Peake – Keep in category for a period of time. Allow exception based on specific criteria.

Michele Couture – Against keeping in a category.

Richard Olson – Don’t keep in categories, wants to leave it flexible, keep it simple.  Don’t want to confuse people on Town Meeting floor.

David Nicolau – Caution issue we hear is – we are losing restaurants and guesthouses.

Cheryl Andrews – Have the guidelines be simple.  Tell people you will have to go to Board of Selectmen to get the gallons.

Winthrop Smith – Supply and demand.  Let demand dictate where the gallons go.

Kevin Rich – Should be very broad.  Don’t limit it.  Don’t want to limit the economic development.

Howard Burchman – What does year round mean?  Must make workable.

What kind of things are we looking for?

     Year Round?

Cheryl Andrews – What we’ve heard is consensus around not keeping the gallons in same categories.

David Nicolau  -  For Guidelines we can look to State’s language for Economic Development Zone.

-       Time limits need to be discussed.

-       Let the economy drive it.

Howard Burchman – What are the real drivers in the economy?   Economic Development Council needs to advise this.  Want to make sure that actions and decisions are impactful

Cheryl Andrews – To get a permit need Economic Development Council vote and Board of Selectmen vote.  What appeal would the applicant have? To the Courts.

The Board discussed and invited the COED to the next Board of Selectmen’s meeting on Monday, September 12, 2005.
