PUBLIC HEARING

 

 

Co-Chair Elaine Anderson called the Public Hearing to order at 6:44 P.M.

 

PUBLIC STATEMENTS: None.

 

MINUTES: October 30, 2007Dieter Groll moved to approve the language as written, David Hale seconded and it was so voted, 3-0.

 

November 6, 2007David Hale moved to approve the language as written, Elaine Anderson seconded and it was so voted, 3-0.

 

OLD BUSINESS:

Notice of Intent

Application by Ronald Chapman, represented by Coastal Engineering Company, Inc., for a Notice of Intent under the Massachusetts Wetlands Protection Act M.G.L. c. 131, § 40 and the Provincetown Wetlands By-Law Chapter 12. The applicant seeks to install a bulkhead for shorefront protection at the property located at 157A Commercial Street, in Provincetown. The applicant requested a continuance. David Hale moved to grant the request for a continuance, Dieter Groll seconded and it was so voted, 3-0.

 

Notice of Intent (continued from November 6, 2007)

Application by Burton I. & Brunetta R. Wolfman for a Notice of Intent under the Massachusetts Wetlands Protection Act M.G.L. c. 131, § 40 and the Provincetown Wetlands By-Law Chapter 12. The applicant seeks to repair an existing timber bulkhead at the property located at 657 Commercial Street, in Provincetown.

Presentation: Katelyn Merrill from East Cape Engineering appeared to discuss the revised project. The new plans propose to stabilize the existing 43’ timber bulkhead and to install sheet piling on the seaward side of that bulkhead. The new sheathing, which will consist of 8” by 18” by 16” sections, will be installed flush to the existing bulkhead.

Public Comment: Dana McCannell, an abutter, had a question about how a bulkhead works and a comment about the amount of build-up of hydraulic pressure on the backside of bulkheads during a storm.

Commission Discussion: The Commission questioned Ms. Merrill.

Dieter Groll moved to approve the Notice of Intent for the property located at 657 Commercial Street with the condition that the scope of work on the revised drawing be included in the Order of Conditions and that the sheathing does not exceed the height of the bulkhead by more than 3”, David Hale seconded and it was so voted, 3-0.

 

DISCUSSION: New Regulations and Fees

The discussion concerning the new regulations and filing fees will be continued until the December 4, 2007 hearing.

 

Conservation Commission Budget FY 08 and FY 07 Appropriation

The Commission very briefly discussed their three accounts. They agreed that adjustments need to be made within the various categories of each budget. Elaine Anderson moved to nominate David Hale for the Commission’s Finance Subcommittee, Dieter Groll seconded and it was so voted, 3-0.

 

Administrative Reviews

Brian Carlson asked the Commission if they are satisfied with how he is informing them of the Administrative Reviews that he reviews. The Commission is satisfied with his reports to them.

 

Oversight of Orders of Condition

The Commission discussed what kind of oversight there was regarding adherence to Orders of Conditions given to current projects approved by the Commission. Brian Carlson says the he visits some projects, he gets complaints on others, which require a visit from him and many projects are required to contact the Conservation Agent before they commence.

 

ANY OTHER BUSINESS:

Violation Report: The Commission discussed the issue of the Harbormaster’s office issuing a violation of the Hydraulic Dredging Regulation. It was a Type 1 violation. As a result, the Department of Marine Fisheries has requested a meeting with the Commission with the Department of Environmental Protection present.

Dieter Groll moved to issue an Enforcement Order accompanied by a letter from the Conservation Commission to Captain Jon Nordahl, of the F/V Kimberly Ann, requesting his appearance at the Commission’s December 4, 2007 hearing to explain his actions and with the further request that he file a Notice of Intent on or before December 24, 2007, which will be heard at the January 22, 2008 hearing, David Hale seconded and it was so voted, 3-0.

 

Banner Ad: The Banner ad for new members was discussed. Elaine Anderson reported on prices for various types of ads. This issue will be put on an agenda for a January hearing.

 

Bissell’s Tennis Courts: Brian Carlson reported that Maxine Notaro, the Permit Coordinator, asked him to find out from the Commission if their Orders of Condition for the project would be different if they knew that the project was going to be done in phases. The Commission discussed this and came to the conclusion that the Orders of Conditions that they issued would stand.

 

Beach-Cleaning Equipment: The Commission would like to put the discussion of the new sand-cleaning equipment, which Elaine Anderson has seen in action, and the issue of beach cleaning on an up-coming agenda.

 

Americorps: Americorps will begin working at the Shank Painter Pond Resource Area starting on January 11, 2008.

 

Grants: Dieter Groll reported that he saw an article about the availability of grants for protection of wildlife habitats for private land owners in the newspaper. Brian Carlson will research this issue.

 

CORRESPONDENCE:

Brian Carlson had procured a grant for the renovations at the Shank Painter Wildlife Sanctuary Trail Restoration Project from the Barnstable County Resource Development Office in the amount of $6,500.00

 

Co-Chair Elaine Anderson made a motion to go into Executive Session for the purpose of discussing personnel issues, polling each Commissioner separately for their vote. Each assented to go into Executive Session.

 

ADJOURNMENT: Dieter Groll moved to adjourn at 9:02 P.M. and it was so voted unanimously.
