PROVINCETOWN CONSERVATION COMMISSION

October 17, 2006

Members Present: Dieter Groll, Elaine Anderson, Dennis Minsky, Paul Tasha and Lynne Martin.

Members Absent: Robin Evans.

Others Present: Brian Carlson (Health Inspector), Erica Larner (Conservation Agent) and Ellen C. Battaglini (Recording Secretary).

 

Co-Chair Dieter Groll called the meeting to order at 6:39 P.M.

 

PUBLIC STATEMENTS:

None.

 

Enforcement Order

John Baldwin, Town Beach at Ryder Street Ext., Provincetown: A large aquaculture vessel was dragged onto the beach by at least 2 front-loaders.

This is continued until the November 7, 2006 hearing.

 

Notice of Intent 

Application by the Independent Environmental Consultants, Inc. , representing Snow Realty Trust I, II, Scott Andonian, Trustee, for a Notice on Intent under the Provincetown Wetlands By-Law, Chapter 12 of the Provincetown General By-Laws, and under the Massachusetts Wetlands Protection Act, M.G.L. c. 131, § 40.  The applicant seeks approval for construction of one single family dwelling on each lot with appurtenances, and the upgrade of sanitary subsurface disposal systems on each lot with appurtenances at the property located at 34 and 36 Snow’s Lane, in Provincetown. This case is continued until the November 21, 2006 hearing.

 

Notice of Intent 

Application by Demetrios Daphnis for a Notice on Intent under the Provincetown Wetlands By-Law, Chapter 12 of the Provincetown General By-Laws, and under the Massachusetts Wetlands Protection Act, M.G.L. c. 131, § 40.  The applicant seeks approval for construction of six new dwelling, retaining walls and appurtenances at 67 Harry Kemp Way, in Provincetown.

This case is continued until the November 21, 2006 hearing.

 

PROPOSED REGULATIONS:

Conservation Commission Local Regulations:

ARTICLE 7: Beach Cleaning.

The Commission discussed this article in regard to the appearance eelgrass on certain areas of the beach. Many people like to collect the eelgrass and use it in their gardens. It was discussed how this activity might be dealt with in the regulations.

Public Comment: Christopher J. Snow commented on the issue of traditional uses of seaweed.

Hersh, a member of the Visitor Services Board, commented that she was told that any seaweed on the beach could not be touched.

Dennis Minsky moved to amend Article 7.6 to read: “These regulations shall not be construed to preclude hand removal of unnatural debris or recreational and minimally invasive “beachcombing”, any of which may be allowed without permitting at the Commission’s discretion.” Paul Tasha seconded and it was so voted, 5-0.

 

Dennis Minsky moved to add the following sentence to the end of Article 7.6: “The Commission strongly encourages the hand removal of unnatural debris.” Lynne Martin seconded and it was so voted, 5-0.

 

Dennis Minsky moved to approve Article 7 in its entirety as amended and effective the day of publication, Dieter Groll seconded and it was so voted, 5-0.

 

CORRESPONDENCE:

Gordon Peabody wrote to Erica Larner regarding concrete over-pours and demolition protocols. Any Commissioner who wants to read the letter can contact Erica.

 

November 7, 2006 hearing – The Commission will approve warrant articles for Special Town Meeting on November 13, 2006.

 

There was a discussion about moving the November 7, 2006 hearing to Monday, November 6, 2006 at the Grace Gouveia Building on Alden Street. The Commission agreed to this.

 

ANY OTHER BUSINESS:

The issue of mowing grass at the transfer station was discussed because of potential harm being done to box turtles whose nesting areas are located in that area.

 

Dieter Groll made a motion to go into Executive Session at 8:07 P.M. for the purpose of discussing pending litigation. Each Commissioner was polled separately and each voted in the affirmative to go into Executive Session.

 

CONSERVATION BOARD STATEMENTS:

The Board briefly discussed the Old Colony Trail Project.

 

ADJOURNMENT:

Dennis Minsky moved to adjourn at 9:00 P.M. and it was so voted unanimously.
