Members Present: Dieter Groll, Elaine Anderson, John Santos, George Bryant and Brian Carlson.

Members Absent: Paul Tasha.

Others Present: Doug Taylor (Building Commissioner), Maxine Notaro (Permit Coordinator) and Ellen C. Battaglini (Recording Secretary).

 

Co-Chair Dieter Groll called the meeting to order at 6:42 P.M.

NEW BUSINESS:

Notice of Intent

Application by Felco Engineering, Inc., representing Michael Winstanley for a Notice of Intent under the Provincetown Wetlands By-law, Chapter 12 of the Provincetown General By-Laws, and under the Massachusetts Wetlands Protection Act, M.G.L. c. 131, § 40 for the property located at 781 Commercial Street in Provincetown. The applicant was not present

John Santos moved to not open the hearing of this case, Elaine Anderson seconded and it was so voted, 5-0.

 

Determination of Applicability

Application by Bronwyn Malicoat, representing Conrad Malicoat, for Request for Determination of Applicability under the Provincetown Wetlands By-Law, Chapter 12 of the Provincetown General By-Laws, and under the Massachusetts Wetlands Protection Act, M.G.L. c. 131, § 40. The applicant seeks approval to remove, reconstruct, and relocate a cottage. The applicant also seeks to enlarge the footprint, increasing the footage from 660 square feet to 2,176 sq. ft for the property located at 320 Bradford Street, in Provincetown.

Presentation: Bronwyn and Conrad Malicoat appeared to present the application.

Public Comment: None.

Commission Discussion: The Commission questioned Ms. and Mr. Malicoat. The Commission requested a more detailed map of the property. The Commission discussed the wetland in the area and its designation and after discussion determined that the applicant should file a Notice of Intent for the project.

Elaine Anderson moved to grant a Positive Determination #1 for the property located at 320 Bradford Street, John Santos seconded and it was so voted, 5-0.

 

 

 

 

Determination of Applicability

Application by Deborah Paine, representing Katzel Nominee Trust, for Request for Determination of Applicability under the Provincetown Wetlands By-Law, Chapter 12 of the Provincetown General By-Laws, and under the Massachusetts Wetlands Protection Act, M.G.L. c. 131, § 40. The applicant seeks approval to repair deck joists and girders in a 24’ by 24’ section of the common deck area. No new piles or footings will be installed; only girders, deck joists and decking will be replaced at the property located at 437 Commercial Street, in Provincetown. This case will be postponed until the March 1, 2005 hearing and will be re-advertised with the correct address of the property in question.

 

DISCUSSION:

Storm Water Management Plan:

The Commission discussed its new responsibility for the oversight of the Town’s Storm Water Management Plan. Also discussed was the cleaning of the storm drains along the Bay beach and keeping the beach clean. It was determined that the Commission would like to have a presentation of the Plan, perhaps by DPW Director David Guertin and/or Deputy Director Sandy Turner. It was agreed that ideally a draft of the Plan would be provided to the Commission before it would be discussed.

Elaine Anderson moved to formally request from the DPW that a draft of the Storm Water Management Plan be sent to the Commission by March 1, 2005 and that a meeting with DPW Director David Guertin and/or Deputy Director Sandy Turner be held on March 15, 2005 to discuss the Plan, Brian Carlson seconded and it was so voted, 5-0.

 

ANNOUNCEMENTS:

The annual Massachusetts Association of Conservation Commissions conference in Worcester is taking place on March 5, 2005. Among the topics to be discussion will be changes in 310 CMR and other amendments to the Wetlands Protect Act.

 

There will be a Department of Environmental Protection workshop held in Lakeville on February 23, 2005.

 

A discussion of the invasive species called Tunicates will be held on March 8, 2005 at the Cape Cod Museum of Natural History.

 

MINUTES: February 1, 2004Elaine Anderson moved to approve the language as amended, John Santos seconded and it was so voted, 5-0.

 

ADJOURNMENT:

John Santos moved to adjourn the meeting at 8:30 P.M. and it was so voted unanimously.
