Chairman Mary-Jo Avellar convened the meeting at 6:00 PM noting the following Board of Selectmen attending: Mary-Jo Avellar, Michele Couture, Austin Knight, Pam Parmakian, Lynne Davies

The following are meeting minutes, in brief. 

 

PROCLAMATION TO FIRE DEPARTMENT

 

Prior to the start of the meeting the Board of Selectmen read and presented a Proclamation declaring Tuesday, September 11, 2007 as “Provincetown Firefighters and Fire Responders Day” to Dan Notaro and Eli Martinez, members of the Provincetown Volunteer Fire Department.

 

The Board of Health called their meeting to order with the following members present:  John Livingstone, Geraldine Anathan, Duane Gregory, Ken Janson, Tom Gaudreau, Health Agent Jane Evans and Health Inspector Brian Carlson

 

1A1      CONFLICT OF INTEREST LAW DETERMINATIONS


MOTION: Move that the Board of Selectmen vote pursuant to MGL C. 268A, §19, and as appointing authority for the Board of Health, to make the determination that the financial interest of appointee, Duane Gregory IS NOT so substantial as to be deemed likely to affect the integrity of the services which the municipality may expect from the appointee.

1B       INFECTIOUS DISEASE EMERGENCY PLANNING and RESPONSE

 

Presentation by Health Inspector Brian Carlson.  Open discussion - no motions made.

 

2.         PUBLIC STATEMENTS

 

Bonnie Campbell – Brainstorm ideas – from living in other states she had a bill that included water fee, sewer fee, and trash pick-up fee. This might help here. Agree with Mary-Jo Avellar to educate visitors to recycle.  Utilize grants more.

 

Tom Thompson - Our  Town Bell is still not working.  I was here a year ago asking why it was not working.  Where are we on this at this time? 

 

Michael Ledger – I want to remind the Board that the recycling laws are not being enforced and when are we going to get serious about it?

 

3.         SELECTMEN STATEMENTS

Congratulations on all the events we had this weekend.  Every event was successful.

 

MOTION: Move that the Board of Selectmen send letters to the organizers of the Swim for Life, the Great Schooner Regatta and the Yankee Lambda Car Club organizers for a job well done on their events this past weekend.

Austin Knight

 

The Deaconess Group is preparing to celebrate the legacy of the Cape End Manor as it prepares to move to Seashore Point – thanking all those from the Cape End Manor by having a special event at the Center for Coastal Studies on  Sunday, October 14, 2007 from 4 to 7 PM.

Town Hall Bell ??   Answer:  Sharon Lynn  - Parts are on order, and the company will be fixing it as soon as the parts come in .. expected within the next two or three weeks.

 

Parking Activity Report.  Send a note of congratulations to Dominique Rosati. 

 

MOTION: Move that the Board of Selectmen send letters congratulating to the Parking Department Dominique Rosati, Debbie Gonsalves and Pat Benatti on their initiative for increasing revenues at the Grace Hall Parking Lot.

Town Hall Renovations?  Answer: Sharon Lynn – Request for Qualifications – We’ve received seven responses.  The review committee is in the process of reviewing them and we are meeting Wednesday of this week, and will have recommendations based on this meeting.  We will take the next steps for that for the Special Town Meeting.

 

Library Boiler?  Answer: Sharon Lynn - Mr. Mulvey has been very instrumental in working with the Mechanical Engineers that we’ve had read all the reports, and has been meeting with the original contractor for the boilers and HVAC systems.  We’re getting positive feedback, and the boilers will be fixed before the season.  Mr. Mulvey is in contact with Town Counsel, and everyone is in the loop. I feel confident that they are going to make good on the boiler.

 

Drug Bust - This has been an ongoing process.  Congratulations to the Provincetown Police and the Chief in particular, and thanks also to Truro and the Barnstable County Sheriffs.  11 people were arrested.

Fees for renting Town Hall -  need to have this as a future agenda item.

In response to Ms. Campbellwe’re trying to lean away from additional fees.

 

Our Grant Administrator is Michelle Jarusiewicz and she does an amazing job at finding money for us.

 

Recycling – this is a big opportunity for recycling, and I applaud all the work that your group is doing. I think that this is a big opportunity for recycling and for some of those regulations to come in to play.

 

I want to remind everyone that the Warrant closes on September 28th.   Moderator papers – the final date to apply is September 21st.

Austin Knight – I want to make sure that the painting of the clock is included.  Answer:  Yes, it will be included  - money was taken from the Capital Improvements Fund for this.

MOTION: Move that the Board of Selectmen vote to appoint Carol MacDonald as a Regular Member of the Animal Welfare Committee with a term expiration date of June 30, 2008

5A       DEPARTMENT OF PUBLIC WORKS

            Declare Surplus Glass Lined Vessels

 

MOTION: Move that the Board of Selectmen vote to authorize the Town Manager, via the Department of Public Works, to declare surplus and to solicit bids for Two (2) glass lined  (+/-)10,000 gallon vessels that have no value to the Town, and are remnants from the oil spill clean-up project in Truro in the late 1980.

5B       POLICE – GRANT APPROVAL REQUEST

            FY 2008 Community Oriented Policing Grant

           

MOTION: Move that the Board of Selectmen vote to approve the application and acceptance of $11,299 from the Executive Office of Public Safety Community Oriented Policing Grant to cover $1000 for Alcohol Server Training, $1000 for Cape Cod Law Enforcement Council training dues, $5600 for specialized professional equipment (in-car computer), and $3699 for continuation of house numbering project.

5C       PARADE PERMIT REQUEST

            Aids Support Group – Harbor to the Bay Bike Ride

           

MOTION: Move that the Board of Selectmen vote to approve the Parade Application Permit submitted  by Patricia Fecher on behalf of the Aids Support Group of Cape Cod, PO Box 1522, Provincetown, MA  to hold their annual “Harbor To The Bay Bike Ride” to be held on Saturday, September 15, 2007 from 7 PM to 7:30 PM.  No rain date.

6A       PAMET LENS OVERSIGHT GROUP - Update

MOTION: Move that the Board of Selectmen vote to instruct the Town Manager to seek funding from the Shared Watersheds, Shared Responsibilities grant program as offered through the County of Barnstable, “Cape Cod Water Protection Collaborative”, Barnstable, MA.

6B       TOWN MANAGER FOLLOW-UP / OTHER

 

Acting Chief Tobias – Gave briefing on the drug bust that happened this past weekend.  Information available on capewidenews.com

 

MOTION: Move that the Board of Selectmen vote to send a letter to Provincetown, Truro and Barnstable Country Sheriff’s Departments expressing our thanks on their good work.

Towing - Contacted Mr. Silva concerning a six months contract. Wouldn’t say he said no.  I think he is looking for help with the storage part portion, fees, and mostly the abandon car issue. He’s looking for some assistance from the town, and he doesn’t feel that he is getting it.

 

Four new officers were sworn in last week, and they started Sunday the 9th.   They will be attending the Reading, MA academy.

 

OTHERCABLE TELEVISION

 

MOTION: Move that the Board of Selectmen vote to instruct the Town Manager to engage the services of William H. Solomon for Legal/Consulting Services – Cable Television for the Town of Provincetown.

Cell Tower -  Seems as though the Wastewater Treatment Plant has gone through the zoning process of allowing and permitting a tower on Route 6, AT& T has entered a contract with the Town and has been paying the Town on a monthly basis to lease the site but has not erected a tower.  That lease has been terminated as of September and it is possible, because of the lease is in place and permitting process has been approved, for another company or ATT/Singular to put a tower up there.  The good news is that if there was a tower erected there that would increase the coverage and reach the airport, and we would not have to wait a great deal of time to get that done at the airport… so we are working on that.

 

In response to Selectmen’s Knight’s ‘Round Table Discussion with other Municipalities” – I did put an email out .. and will be attending a Cape Manager’s meeting this week, and will ask about that further.

 

Report to pass out .. Again the good news is that Susan Connelly has been located and has responded, and we have a draft RFP for the 90 Shankpainter Road project. This memo indicates where we are with that initiative. 

 

6B1      RECYCLING COMMITTEE – GRANT REQUEST

Commonwealth’s Municipal Sustainability Grant Application

 

MOTION: Move that the Board of Selectmen vote to authorize the submission of a grant application for public area recycling containers, consumer outreach, and education materials under the Commonwealth’s FY 2008 Municipal Sustainability Grant.

From the last hearing a lot of people complaining about the dogs and the residue left on the beaches and such .. have we had any fines?  Answer:  Sharon Lynn -  The number of dog complaints – January ’07 through September to-date 203; number of dog complaints on the beach same time period 38; number of warning issued 179; number of citations issued 24.
