Issuance of Marriage Licenses in the Town of Provincetown

Policy Statement Adopted by the Provincetown Board of Selectmen, March 15, 2004; Revised May 10, 2004

Out-of-State Couples: Read the May 26th statement issued by the Provincetown Board of Selectmen temporarily suspending issuance of marriage licenses to out-of-state same-sex couples not intending to reside in Massachusetts. Provincetown continues to issue licenses to out-of-state same-sex couples intending to reside in Massachusetts. Issuance of Marriage Licenses in the Town of Provincetown.
It shall be the policy of the Provincetown Board of Selectmen that the Town Clerk may issue marriage licenses to any persons-- whether residents of the Commonwealth of Massachusetts, non-Commonwealth residents that intend to reside in Massachusetts, or non-Commonwealth residents that do not intend to reside in Massachusetts-- who complete the revised "Notice of Intention of Marriage" form prescribed by the Massachusetts Department of Public Health and affirm the following statement thereon: "I have reviewed a list of impediments to marriage for my place of residence and hereby state that there is an absence of any legal impediment to the marriage and do hereby depose and say that all of the statements as set forth in the above notice whereof I could have knowledge are true and are made under the penalties of perjury (c.4, s.6, Rule 6 General Laws)."

Town Counsel's opinions relative thereto shall be kept on file at the Office of the Town Clerk and made available for public inspection.

INFORMATIONAL NOTICE
TO
OUT-OF-STATE COUPLES INTENDING TO RESIDE
OUTSIDE OF MASSACHUSETTS


Be aware that if you are issued a certificate of marriage it is possible that the Registry of Vital Records and Statistics may refuse to accept and record the completed certificate if the Registry or another state entity determines that an impediment to your marriage exists in your state of residence.

If an impediment to marriage exists in your state of residence, a substantial question exists as to whether the marriage will be legally recognized in Massachusetts or your state of residence, even though a certificate of marriage has been issued to you in Massachusetts.
