PERSONNEL
BY-LAW
1. Purpose
1-1 The purpose of the Personnel By-law is to establish a system
of personnel administration based on merit principles that ensure the uniform,
fair, and efficient application of Personnel Rules, the Appraisal System, and
the Classification and Compensation Plan.
2. Application
2-1
All town departments and positions shall
be subject to the provisions of this by-law, except those of the school
department. To the extent that any collective bargaining agreement conflicts
with any provisions of this by-law or personnel policies adopted pursuant to
Section 6-11-2 of the Charter, the provisions of the collective bargaining
agreement shall prevail. This by-law is
adopted pursuant to Chapter 41, sections 108A and 108C of the General Laws.
2-2 It is specifically recognized that inclusion in the
Classification and Compensation Plan below of positions covered by collective
bargaining agreements is for illustrative purposes only, and that establishment
of and/or amendments to such plans with respect to such positions shall be made
by collective bargaining agreement between the Town and the Union pursuant to
Chapter 150E of the General Laws, which agreements shall serve to amend said
Classification and Compensation Plan below with respect to such positions.
3. The Personnel System
3-1 The personnel system shall be based on merit principles, and
shall include Personnel Rules adopted under Section 6-11-2 of the Charter, an
Appraisal System for evaluating the performance of all Town employees; and a
classification plan and compensation plan which shall (1) classify all
non-union paid Town positions into groups and classes doing substantially
similar work or having substantially equal responsibilities; and (2) establish
minimum and maximum salaries to be paid to employees in positions so
classified; which plan shall be a part of this by-law.
4. Administration of the Personnel System
4-1 The classification and compensation plan and appraisal system shall
be administered in accordance with Personnel Rules adopted pursuant to Section
6-11-2 of the Charter.
4-2 The Personnel Board shall review any proposed amendment to the
classification and compensation plan proposed, and issue its report and
recommendation thereon to the town meeting on whose warrant such amendment
shall appear.
5. Severability
5-1 The provisions of this by-law are severable. If any by-law provision is held invalid, the
remaining provisions of the by-law shall not be affected thereby.
6. Effective Date
6-1 This by-law
shall take effect on July 1, 1991.
